1. Introduction & Acceptance
Welcome to HustlePayMe, a service provided by HustlePay Inc. By accessing or using our platform, mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. User Responsibilities
As a user of HustlePayMe, you agree to:
- Provide accurate and complete information when creating an account
- Maintain the security of your account credentials
- Use the Service only for lawful purposes
- Not engage in fraudulent transactions or misrepresent your identity
- Comply with all applicable laws and regulations in your jurisdiction
- Report any unauthorized use of your account immediately
3. Payment Processing
HustlePayMe facilitates payment transactions between tippers and earners. We partner with third-party payment processors including Stripe and Finix to handle all financial transactions. By using our Service, you authorize these processors to charge your selected payment method and transfer funds to earners. All transactions are final once processed, except as otherwise provided in our Dispute Resolution section.
4. Fees & Payout Rules
Our fee structure is designed to be transparent and fair:
- Tippers: No fees charged for sending tips
- Earners: Standard processing fee of 2.9% + $0.30 per transaction
- Instant payouts: Additional 1.5% fee for immediate fund transfers
- Standard payouts: Free, processed within 1-2 business days
- Minimum payout threshold: $10.00
Fees are subject to change with 30 days notice to active users.
5. Prohibited Uses
The following activities are strictly prohibited on HustlePayMe:
- Money laundering or terrorist financing
- Fraudulent chargebacks or payment disputes
- Creating fake profiles or impersonating others
- Soliciting tips through deceptive means
- Using automated systems or bots
- Circumventing platform security measures
- Any activity that violates local, state, or federal laws
6. Dispute Resolution
In the event of a dispute between users or regarding a transaction, we encourage parties to first attempt resolution through our in-app support system. If a resolution cannot be reached, disputes will be handled through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and jury trials are waived by accepting these Terms. For disputes under $10,000, we offer a simplified online arbitration process.
7. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may also terminate your account at any time through your account settings. Upon termination, any pending payouts will be processed according to our standard schedule, and you will lose access to your account history and any accumulated rewards.
8. Limitation of Liability
To the maximum extent permitted by law, HustlePay Inc and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the total fees you have paid to us in the twelve months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
